Road traffic regulations (Code de la route)

Reglementation

In the strict sense, the Road traffic regulations (Code de la route) consists of the amended Grand Ducal Decree of 23 November 1955 regulating traffic on all public roads (Memorial A no. 66 of 1955). In addition to the Code de la route, the following legal texts also concern road traffic (non-exhaustive list):

  • the amended law of 14 February 1955 on the regulation of traffic on all public roads (loi modifiée du 14 février 1955 concernant la réglementation de la circulation sur toutes les voies publiques);
  • the amended grand-ducal decree of 23 November 1955 on the regulation of traffic on all public roads (arrêté grand-ducal modifié du 23 novembre 1955 portant règlement de la circulation sur toutes les voies publiques);
  • the amended grand-ducal decree of 26. August 1993 on warnings subject to charges, deposits for non-resident traffic offenders and measures to implement the legislation on vehicle impoundment and points-based driving licences (règlement grand-ducal modifié du 26 août 1993 relatif aux avertissements taxés, aux consignations pour contrevenants non-résidents ainsi qu'aux mesures d'exécution de la législation en matière de mise en fourrière des véhicules et en matière de permis à points).

 

The amended law of 14 February 1955 (loi modifiée du 14 février 1955) defines the competences and legal aspects relating to the following:

  • the authorisation to issue, modify or withdraw driving licences;
  • the driving licence with points;
  • special authorisations to increase the number of trailers, the maximum dimensions or the maximum mass of road vehicles;
  • the use of special audible signals;
  • type approval, registration, roadworthiness testing and approval;
  • the approval of roadworthiness testing organisations;
  • the management of state and municipal roads;
  • the rights of law enforcement officers;
  • cases of serious offences, hit-and-run, homicide, abandonment of the vehicle or failure to comply with the maximum authorised mass;
  • driving under the influence of alcohol or drugs or while impaired;
  • the modalities of a driving ban, its modulation and its cancellation;
  • chargeable warnings and fines.

 

The amended Grand-Ducal Decree of 23 November 1955 (arrêté grand-ducal modifié du 23 novembre 1955) lays down the provisions and procedures relating to the following:

  • the equipment of vehicles (loads, trailers, towed vehicles);
  • the direction and stop signals;
  • the carriage of passengers;
  • the vehicle documents;
  • the driving licence (training, probationary period, training courses, exchange);
  • the roadworthiness certificate and the conformity sticker;
  • the authorities responsible for public roads;
  • the traffic signs;
  • the rules of the road;
  • stopping, parking and parking;
  • the penalties.

 

The amended Grand-Ducal Regulation of 26 August 1993 (règlement grand-ducal modifié du 26 août 1993):

  • lists all the penalties for offences against the Road traffic regulations;
  • sets out the provisions for the impounding of vehicles.
