Driving licence commissions
In the area of driving licences, the Minister responsible for transport is responsible for handling legal disputes, the points system and medical matters.
To fulfil these tasks, the Minister draws on the relevant departments of his Directorate for Transport and Road Safety, which is supported in its tasks by:
- the Special Commission for Driving Licences;
- the Medical Commission.
The special commission for driving licences
If the driving licence documents of the person concerned show that they have committed offences in connection with driving a vehicle, the Minister responsible for transport shall instruct the Director of the Grand Ducal Police to initiate an administrative investigation. Based on the results of this investigation, the Minister or his representative shall decide whether the person concerned shall be summoned before the Commission in order to take administrative measures against them.
This commission shall in all cases consist of three members appointed by the Minister of Transport. Its task shall be to investigate the case, hear the explanations and objections of the person concerned, draw up a report and issue a reasoned opinion.
The Minister shall take a decision on the basis of the aforementioned opinion. This decision shall be communicated to the person concerned either by simple letter or by ministerial decree.
The medical commission
Its main task is to provide the Minister responsible for transport with opinions on medical fitness to drive when a user applies for or wishes to renew a driving licence. It also checks all medical certificates required for the driving licence and may request additional medical certificates if the user's state of health so requires.
The commission is headed by a doctor and is composed of doctors and officials from the Directorate for Transport and Road Safety. It may appoint experts to conduct practical tests with drivers if their state of health so requires.
The commission may issue opinions based on files or hear persons suffering from physical or mental disorders or drug or alcohol addiction. It ensures medical follow-up through regular check-ups that the persons concerned must undergo.
It consists of three members for each case it deals with. It may propose to the Minister of Transport that a driving licence be withdrawn, returned, restricted in its validity and use, or that a vehicle be converted for use by persons with disabilities. The measures to be taken are recorded in ministerial decisions addressed to the persons concerned.
The Commission may also propose to the Minister of Transport that exemptions from the obligation to wear a seat belt be granted in medically justified cases (Article 160 bis of the Road traffic regulations (Code de la route)).
