The objective pursued by the Government in setting up the automated enforcement system for road traffic offences (= CSA system) in Luxembourg is to improve road safety in the sense that the CSA system should enable checks to be carried out, particularly in dangerous and accident-prone locations.

Principle

All vehicles are affected, regardless of their country of registration. This equal treatment also applies to company, service, and rental vehicles.

A margin of error is deducted from the traffic speed measured by the automatic radar:

  • 3 km/h up to 100 km/h;
  • 3% of the speed measured above 100 km/h.

Sanctions

Fine of 49 euros

Failure to comply with the prescribed lower speed limit:

  • 15 km/h to the maximum permitted speed within built-up areas;
  • 20 km/h to the maximum permitted speed outside built-up areas;
  • 25 km/h to the maximum permitted speed on motorways.

Fine of 145 euros + deduction of 2 points on the driving licence

Failure to comply with the legal speed limit:

  • exceeding 15 km/h and the maximum permitted speed in built-up areas;
  • exceeding 20 km/h and the maximum permitted speed outside built-up areas;
  • exceeding 25 km/h and the maximum permitted speed on motorways.

Legal proceedings

Exceeding the legal speed limit by more than 50% of the maximum speed limit, with the speed being at least 20 km/h above this limit.

Exceeding the legal speed limit, which is considered a violation or serious violation, will result in a ticket and a fine.

The fee-based warning will be replaced by a regular legal proceeding if, for example:

  • the offender has not paid on time;
  • the offender declares that he or she does not want or cannot pay the tax(s);
  • if the speed limit is exceeded by more than 50% of the maximum speed and by at least 20 km/h above this maximum speed.

Example with a maximum permitted speed of 70 km/h

If the speed limit is 70 km/h, the radar will flash at 74 km/h (the tolerance threshold is 73 km/h inclusive).

For speeds between 74 km/h and 93 km/h, the fine is 49 euros.

For a recorded speed between 94 km/h and 109 km/h, the violation is punishable by a fine of 145 euros and the loss of two points on the driver's license.

For speeds above 110 km/h, the offense is reported to the public prosecutor's office. The judge decides on the amount of the fine and the length of the driver's license suspension.

How do radars work?

Fixed radars measure speed in both directions of traffic! The vehicle is photographed from the front and rear. The radar can also measure and photograph on three channels simultaneously.

The installed radars can also distinguish between cars, trucks, and motorcycles.

As soon as a speed violation is detected, the radar flashes the vehicle, making its license plate and driver visible.

The procedure after flashing

The photo is recorded and automatically sent to the National Processing Center in Bertrange, where the offense is recorded by a police officer who identifies the holder of the registration certificate.

The holder will be notified by registered mail no later than four weeks after the violation.

The holder must pay or file an appeal within 45 days (form attached to the administrative offense report).
